Terms & Conditions Photographed On Content Submissions

1. Introduction

These Terms & Conditions ("Terms") govern the submission of photographs, associated data, and personal information to Photographed On (the "Platform"). By submitting a form containing links to your published work and image files ("Content"), you ("Submitter") agree to be fully bound by these Terms.

2. License Grant

You retain full copyright ownership of your Content. However, by submitting your Content, you grant the Platform a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Platform's services. This includes, without limitation, promoting and redistributing part or all of the Platform across any media formats and through any media channels.

3. EXIF Data Extraction and Publication

You explicitly grant the Platform the right to programmatically or manually download the provided image files, parse, extract, store, and permanently publicly display all associated metadata embedded within the files (commonly known as "EXIF data"). This includes, but is not limited to: camera make, camera model, lens model, focal length, aperture, shutter speed, ISO, and date/time of capture.

4. Privacy and Personally Identifiable Information

You acknowledge that EXIF data embedded in image files often contains sensitive or personally identifiable information (PII), such as precise GPS location coordinates, copyright strings, and camera serial numbers. By submitting your files, you explicitly consent to the extraction, storage, and potential publication of this data. If you do not wish to share specific metadata (e.g., location), you are solely responsible for stripping such data from the image files prior to submission. Your submitted name and email address will be stored for attribution and platform communication purposes.

5. Representations and Warranties

By submitting Content to the Platform, you represent and warrant that:

  • You are the sole creator and copyright owner of the submitted Content, or you have obtained all necessary licenses, rights, consents, and permissions to grant the licenses set forth in these Terms.
  • The Content does not and will not infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
  • You have obtained appropriate model releases and/or property releases for any identifiable individuals or private property depicted in the Content.

6. Indemnification

You agree to defend, indemnify, and hold harmless the Platform, its operators, affiliates, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) Your use of and access to the Platform; (b) Your violation of any term of these Terms; (c) Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) Any claim that your Content caused damage to a third party.

7. Limitation of Liability

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. The Platform operators disclaim all warranties, express or implied. The Platform shall not be liable for any unauthorized third-party scraping, downloading, or misuse of your submitted Content or EXIF data once displayed publicly on the internet.

8. Right to Remove or Modify

The Platform reserves the right, at its sole discretion, to review, accept, reject, modify, or permanently remove any submitted Content without prior notice or justification.
